may discontinue or restrict your use of www.mymovingservice.com for any reason without notice and without any liability to you. In addition, when using www.mymovingservice.com. you shall be subject to any posted guidelines or rules applicable to the Service, which may be posted at any time and which are hereby incorporated by reference into these Terms and Comditions.
Section 1. Intellectual Property.
All content displayed on www.mymovingservice.com, including without limitation any pictures,logos, images, text and this website template is the property of MBMT Corporation or its licensors, and is protected by copyright, trademark, and the intellectual property laws. By accessing www.mymovingservice.com, you agree not to reproduce, retransmit, distribute, disseminate, display, sell, publish, broadcast or circulate the content of www.mymovingservice.com to anyone
Section 2. Indemnity.
You hereby release, and agree to defend, indemnify and hold harmless MBMT Corporation, its parent, and affiliated companies, along with their respective officers, directors, employees and agents from any and all claims, demands, causes of actions, liabilities, damages, costs and expenses, including reasonable attorneys' fees, arising out of your use or viewing of www.mymovingservice.com and its content.
Section 3. 3rd party links. This website may contain hyper-links to websites operated by persons other than MBMT Corporation. You agree not to hold MBMT Corporation responsible for the content or operation of such websites. A hyper-link from www.mymovingservice.com to another web site does not imply or mean that www.mymovingservice.com endorses the content on that web site or the operator or operations of that site. You are solely responsible for determining the extent to which you may use any content at any other web sites to which you might link from from www.mymovingservice.com.
Section 4. Deposit Payment & Refund Policy.
A deposit payment or payment hold of up to $250 may be applied to your debit or credit card at booking time; not to be construed as the final balance. Once booking is completed, no refund is available due to stringent arrangements made to provide service to you. However, you may opt to reschedule and use the deposit payment for a new service date, which is subject to availability.
Section 5. Booking Confirmation.
A confirmation email with details of your order and these terms and conditions is automatically sent to your email provided at booking time. If you do not receive a confirmation email, please contact us (404) 602-0011. Please remember to check your spam or junk mailbox.
Section 6. Independent Contractors.
By Booking services on www.mymovingservice.com, you acknowledge and agree that all services requested on www.mymovingservice.com is rendered by an independent contractor. All Independent contractors have passed a background and drug test. Because we only operate a web site and do not provide any of the Services, We are not responsible for resolving any disputes between You and independent contractors assigned to complete your service. You agree that all of these types of disputes must be resolved between You and Independent contractor. Furthermore, your booking request and its acceptance by independent contractor and if applicable, any resulting provision of Services, are solely between You and independent contractor. Therefore, when and where there are any claims, demands, liabilities, damages or losses incurred as a result of the same, You, your heirs, successors and assigns, do hereby waive and release MBMT Corporation (Our officers, directors, agents, parent, subsidiaries, affiliated companies and employees) from any such claims, demands, liabilities, damages or losses. You acknowledge and agree that both You and the independent contractor each have the right to pursue a claim against one another in a Court of competent jurisdiction or in another similar forum of dispute resolution.
Section 7. Billing Time. You must be ready when the movers arrive. Billing time starts the moment the movers begin handling your household goods and ends at the signing of the invoice. In the event of driving to another location for unloading purposes, billing time continues while in route.
Section 8. Equipment. Independent Contractors will only provide moving blankets for load & unload service. If you only need loading or unloading help, We suggest purchasing "textile moving blankets/skins" which provide adequate protection for 1-2 usages. You can find "textile moving blankets/skins" affordably priced online. One Shrink wrap roll is available for your use at your request at no additional cost. Additional shrink wrap roll is available at a price of $25/roll. Tape isavailable at a price of $10/roll. We suggest purchasing "moving supplies" prior to your service. Independent contractors are also equipped with hand trucks, dollies and basic hand tools at no extra cost.
Section 9. Arrival Time. Please allow a (3) three hour window for uncontrollable situations that may occur. Few and far between, Independent contractor will immediately notify you with an estimated time of arrival (ETA). Independent contractor cannot predict, nor can be held responsible, or liable for a late arrival as a result of weather, traffic, mechanical failure, or other factors outside of the independent contractor’s control.
Section 10. Boxes/Stairs/Assembly/Reconnect.You are obligated to have completed packing your property into appropriate boxes and other containers before the movers’ arrival. Independent contractors do not pack and unpack boxes during a load/unload service. Therefore, please have boxes ready for loading upon arrival. This includes items not limited to such as, Flat Panel TVs, marble and glass furnishings that require the original box container or crate by a professional service. We do not charge extra for the number of boxes to handle or stairs to climb. There are no additional fees for reassembly of beds or reconnecting washers and dryers. We do not disconnect/reconnect gas ranges, which should be serviced by a professional.
Section 11. Heavy, Fragile or improperly packed items.
Independent contractors reserve the right to refuse to move any items that they feel are unmovable. You agree to protect, defend and hold MBMT Corporation harmless for damages or legal consequences resulting from acts that independent contractors perform at your direction. Both parties expressly disclaim and exclude liability for wear from normal used adjustments, consumable items, loss of revenue, damage from road hazards and accidents,fire and acts of God including, but not limited to rain, wind, flood, hail, sun and damage caused by improper packing.MBMT Corporation will not be responsible or held liable for damages to the customer’s flooring or walls. Independent contractors are not responsible for items left inside of furniture, Unprotected Glass that has not been wrapped properly, Standing Pole Lamps that have not been disassembled and packed securely in a sealed box. MBMT Corporation are not responsible or assume any liability for items that are loaded into your vehicle or container.
Section 12. Dispute Resolution. In the event of breach or a dispute that cannot be resolved without third party intervention, the Parties agree to resolve their dispute in arbitration. The Parties agree to resolve any dispute in Dekalb County, GA.
Section 13. Maximum Price & Final Balance. There is no maximum price limit no matter what the final balance is. We understand the requirements and intricacies of service provided to you and will not charge you for any additional costs or for any services not described in these terms and conditions. Once the job is completed, you will be given an invoice and/or/receipt confirming balance plus applicable taxes, for payment on the spot, with a major credit card only. Personal checks and money orders not accepted. We do not offer shipping services therefore there will not ever be a fee for shipping.
Section 14. Insurance/Damage Claims.
Independent Contractors accept the responsibility for accidental damage to your items. We provide "Released Valuation" mandated at $.60/lb/article up to $250 unless arrangements for purchasing additional coverage is made prior to your service. Claims for damage not made within (10) calendar days in writing to claims@mbmtcorp.com are NULL & VOID.
